1. ROBERT H1 HAMBLETON was born 1765 in Amhurst Co, VA, and died 1841 in Amhurst Co, VA. He married NANCY JANE SUSIE RIPPETOE Dec 25, 1809 in Nelson Co, VA, daughter of PETER RIPPETOE and MILLIE HAMILTON. She was born 1794 in Orange Co, VA. (My 4th Great-Grandparents)

From Nelson Co. records book found in Nelson Co. Library, Security for theirmarriage was posted by Peter Rippetoe. Robert HAMBLETON was buried about 1841 in Clements Cemetery, Franklin Creek, Amherst Co., VA. According to family legend via Mary Blankenship, Robert got made at the folks on Thrashers Creek and was buried in the Clements Cemetery on Franklin Creek in Amherst Co. VA. Franklin Creek is the creek next to Thrashers Creek. He served in the military 1777 Revolutionary War in Amherst Co. VA.15 From the Coffey book by John Taylor, "Osborne Coffey (eldest son of William the elder) put up bail for Robert Hamilton in a court case in 1785. In 1793, Peter Rippetoe, who probably lived in that area (Piney Mountain in present day Nelson County) brought a case of assault and battery against Robert Hambleton. In 1799, William Sale complained that Robert Hambleton was disturbing the peace and Robert had to provide some $300.00 in bond mone which was put up by Andrew and William Hambleton, (possibly his brothers). "Hot-headed" Robert counter sued and Sale was placed in jail. The two were ordered to stay away from each other for a year... On 7 Dec 1827, he bought 192 acres on Thrasher's Creek from William Hannah and his wife Jane, of Betancourt County for $768. This is where he lived and died. The log house that he built on the land is still standing. He married Sussie Rippetoe who may have been his second wife. One index shows a Robert Hambleton, Bachelor, marrying Milley Mays, spinster on 10 May 1791 in Amherst County".

Nancy Rippetoe was married to Robert HAMBLETON on 25 Dec 1809 in Nelson Co, VA.

From papers found at the Virginia Historical Society; MSS1M3855A, Massie Family Papers 1698-1875; Section 19, Indentures of Thomas Massie 1747-1834 of Frederick (now Clark) Amherst and Nelson Co, VA. Articles of Agreement made between Thos. Massie and Robert Hambleton both of Nelson Co, VA.

The said Massie bargains with Rob. Hambleton as an Overseer for the ensuing year 1812. To overlook say fifteen Slaves on the Plantation on Hat Creek that Massie purchased of (unreadable first name) F. Rose. - It is agreed between the parties that Rob. Hambleton is to have one twelfth part of all the _ _ _ _ crop that he may make on the land during the said year. - Viz. Tabacco, corn, wheat, oats, hemp, flax & C. but Hambleton is to pay for one twelfth parts of small grains that may be sowed in the land also a twelfth part of hemp and flax seed if any should be saved. - There are to be five mules or horses on the place to work the crop with and common plantation tools found by said Massie. - Hambleton is to cultivate as well as he can the sand pointed out by said Massie and sow the small grains in the fall and collect the Fodder for the plantation use. Massie is to find Hambleton Six hundred weight of salt pork for the year, with reasonablet quantitiy of salt and bread for his Familys use - also the milk of one or more cows as it may be convenient.

Hambleton will fix up a comfortable house for himself & c to live in on this side of hat Creek of Rock Springs also some cabbins for the negroes. Attest - As _ _ _ _ our hand Sept. 16th 1811

Rives' Nelson Artillery
Brief History of the Battery

Organized in the town of Massies Mill, Nelson County, Rives' Battery was enlisted August 1, 1861. Dispatched to Richmond for training, the battery was sent north to Dumfries, Virginia on December 13, 1861 joining Whiting's division at that point. Spring 1862 found the company moving to Yorktown and then back to Seven Pines, but not being engaged at either place. Following the battle of Seven Pines the company was assigned to Stark's battalion, Gen. Wise's brigade at Chaffin's Bluff. here a bitter personal rift between Rives and Wise developed.

On August 20, 1862 the battery was transferred to Lightfoot's battalion, Richmond Defense forces. Rives and his men spent the remainder of the war, except for a brief foray to Orange in the spring of 1863, in and around Richmond. They moved camp several times and took part in several engagements, perhaps the most notable being the repulse of Kilpatrick's forces during Dahlgren's raid. The battery was stationed just east of Richmond on April 2, 1865 when it was ordered to break camp and join Gen. Walker's column on the march to Appomattox.

Follow-up #2 ! I also find that I your ancestors are also related by marriage to folks on my FATHER's side! Rebecca Hambleton was married to Abraham Clements, son of my dad's ggrandparents, Jesses Clements and Mary Martin. She was also married to a Coffey and her children from that marriage - Frederick, Nancy, John, Matthew, Pauline and Nelson - are listed as members of Abraham's household in the l850 census. He died in the Civil War in l862.

Incidentally, other Hambleton siblings also married into this family. Robert married Abraham's sister Isabella and James Preston married another sister, Nancy Jane. Robert went to Missouri with the Clements wagon train and contracted an illness (swamp fever) and died shortly after his return.

HARRISONBURG, VA.
JUNE 6TH, 1862


Harrisonburg, Va., June 6, 1862. Advance Guard, Fremont's Army. At 2 p.m. the advance guard of Maj.-Gen. J. C. Fremont's army entered Harrisonburg, driving the enemy's rear-guard through the town and following in close pursuit. At 4 p.m. the 1st N.J. cavalry fell into an ambuscade to the southeast of the town, losing severely, its commander, Col. Wyndham being captured. Col. Cluseret subsequently engaged the enemy, driving him from the woods. At 8 o'clock a battalion of Kane's Pa. regiment charged and drove the Confederates off. An attempt to shell the Federal camp was frustrated by a few well directed shots from a Union battery. The losses on both sides were heavy; one Union regiment alone losing over 40 in killed and wounded, but the exact number was not reported.

James and Nancy Jane are buried on Thrasher's Creed (upper area
in what became Mr. Clarke Campbell's "Upper Orchard"). The
Hamilton graveyard was located in upper edge of orchard.
Graves are marked with field stones. There is some quesiton as
to whether Robert Hamilton is buried there. It is said by his
daughters Signora, Nannie and Lucy, that Robert got mad with
some folks on Thrasher's Creek and requested that he not be
buried there. They thought he may have been brought to
Franklin Creek to the Crawford's graveyard where his daughter
Catherin "Kitty" Hamilton and six children were buried (they
had died with Scarlet Fever.) Kity's husband William Mansfield
"Mac" Crawford and two children, Tom and Betsy survived. In
digging a grave in the Crawford graveyard in latter years, they
uncovered a "coal Black" haired body which they assumed was
Robert Hamilton.

I am seeking information about Stuart Newsome (son of Bryan Newsome and Lily Hamilton), who died in the Virginia State Peniteniary around the late 1950's/early '60's. He was serving a life sentence for murder, but I do not know the victim's name nor the date the crime occurred, and would like to consult the court records and newspaper accounts.

I'm seeking information about Mrs. Violet Applewhite, born about 1900, who was murdered in Richmond, VA on January 19, 1932 by Stuart Newsome (a distant relation of mine). She was divorced, and I don't know her maiden name or her ex-husband's first name at this point. She had three children, Edward (elsewhere in the article referred to as "Howard"), b. about 1919, who witnessed his mother's death, Lora, b. about 1921, and Raymond, b. about 1925. I have the article from the Richmond Times-Dispatch detailing the murder.

PER CURIAM.

After a state jury trial the petitioner, Stewart W. Newsom, was convicted of murder and sentenced to imprisonment in the Virginia State Penitentiary. State remedies having been fully exhausted, Newsom sought federal habeas corpus. He alleged that he was deprived of his constitutional rights by being denied counsel in a direct appeal which he desired to prosecute in the Supreme Court of Appeals of Virginia. The Commonwealth's answer is that his right to counsel was waived under circumstances which we shall now relate.

Represented by privately retained counsel, Newsom was convicted on April 10, 1953. He alleges that upon his conviction he asked his lawyers to prosecute an appeal but that they refused when told that he could not raise an additional fee of $500. They noted no appeal on his behalf. Petitioner then wrote two letters to the trial judge within two weeks after the conviction, the first expressing his desire to appeal, the second asking that counsel be appointed. Neither letter was answered. In May, before expiration of the 60-day period permitted for taking an appeal, the defendant wrote another lawyer asking for assistance. That lawyer agreed to investigate the case for

Page 905 $100, before deciding whether to represent him. Not until seven months later were the results of that investigation made known to the prisoner. The record and briefs do not indicate what the lawyer reported to Newsom, except that employment was declined.

The state trial court, after conducting a hearing on defendant's habeas corpus petition, held that the petitioner did have a right to counsel on appeal but that this right had been waived by failure to assert it properly. It was said that the defendant should have asserted his indigency explicitly. 1 The opinion of the state habeas judge was that the petitioner was not indigent since he had personal resources, $40 in cash and an insurance policy of the value of $110 or $150. The court also found, on the basis of the trial counsel's testimony, that Newsom never asked his trial counsel to continue representing him. The case was eventually taken to the United States Supreme Court where certiorari, though initially granted, was later denied as improvidently granted. Newsom v. Smith, 365 U.S. 604, 81 S.Ct. 774, 5 L.Ed.2d 803 (1961) (three Justices dissenting).

Newsom then submitted a habeas corpus petition to the District Court. There relief was denied without a hearing, the District Judge reasoning that the denial of certiorari indicated the Supreme Court's view that the case was without merit, and because, as the state court found, the defendant had waived his right to counsel on appeal.

We are of the opinion that denial of certiorari is not to be given the effect of a judgment on the merits. We are further of the view that Newsom, in his letters to the trial judge, sufficiently indicated his desire to appeal and to have counsel and that his meagre means were not sufficient to disentitle him to consideration by the court as an indigent. A layman's letter seeking legal aid need not be prepared with the nicety of a lawyer's pleading, and if Newsom's letters did not sufficiently indicate his financial predicament, a simple inquiry by the Judge would have disclosed the fact. Instead the letters were ignored.

At the hearing of the appeal in this court it was asserted that if the two letters expressing a desire to appeal are treated as a notice of appeal, then under recent practice in the Supreme Court of Appeals of Virginia that court may be willing to appoint a lawyer and to hear the case. We will remand the case to the District Court with directions to retain it for a reasonable time to permit application to be made to the Supreme Court of Appeals of Virginia to entertain the appeal. If there is still an opportunity for an appeal in that court, there is no need to entertain federal jurisdiction. If the Supreme Court of Appeals of Virginia will not hear the appeal and a retrial is unavailable then the District Court should order Newsom's release.

Remanded with instructions.

'In lue of any known action on the part of my attorney, I am taking this method of respectfully noting an appeal from the 'life sentence' imposed upon me in your Court on April 10, 1953.

On April 23, 1953, he wrote again:

'Due to circumstances beyond my control, I have been unable to complete arrangements with an attorney to complete my appeal.

After oral argument and full consideration, held the record does not adequately establish that the State Supreme Court found or was required to find that the federal claim was presented to it; the case fails to present a federal question; and the writ of certiorari is dismissed as improvidently granted. In April 1953 petitioner was found guilty of murder in the first degree and was sentenced to life imprisonment in the state penitentiary. At the trial, petitioner had been represented by counsel, although at allocution he had complained that his counsel had failed to present relevant evidence. On April 18, 1953, petitioner wrote to the trial judge at his trial,[Footnote 1] noting an appeal within the time allowed therefor under Virginia law. In a second letter written five days later,[Footnote 2] petitioner requested "that

you appoint me counsel to appeal my case to the State Supreme Court of Appeals." To neither letter did he receive any reply. He took no further steps to appeal his conviction.

In January 1959 he filed in the Virginia court a petition for a writ of habeas corpus. The Law and Equity Court of Richmond concluded that the petition did not allege "a failure of the trial court to accord to the accused those procedural safeguards guaranteed to him by the state and federal constitutions," and accordingly denied the writ. Petitioner sought review by the Supreme Court of Appeals, and that court refused to issue a writ of error. Then petitioner sought review here, and certiorari was granted. 363 U.S. 802.

The question raised by petitioner is substantial: Does the Federal Constitution obligate the several States to appoint counsel to assist indigent defendants to pursue whatever appellate remedies the States may offer? Cf. Griffin v. Illinois, 351 U.S. 12.

The opinion of the Law and Equity Court of Richmond discussed the problem of this case in those terms. After an extended discussion of the right of indigents to counsel, that court quoted from 55 A. L. R. 2d, at p. 1085, 2 L. Ed. 2d, at p. 1649, the following:

". . . Thus, the establishment of the rule that a state must, as a matter of federal constitutional law, provide indigents with the assistance of counsel to prosecute appeals in criminal cases would appear to be no more than a logical extension of the Griffin doctrine."

It then added:

"Whether this view be correct or incorrect is, of course, the question in the instant case."

And the Supreme Court of Appeals in refusing a petition for writ of error said that the judgment was "plainly right." Regardless of whether the courts below were "required to find" that petitioner had adequately stated his federal claim, those courts in fact did so find as the adjudication was on the issues exposed in the record.[Footnote 3]

The question whether the Equal Protection Clause of the Fourteenth Amendment requires appointment of counsel for indigents to represent them on appeal from state court judgments of conviction is present and ripe for decision. I dissent from the dismissal of the certiorari.
